In the footer of the Ice TimeTM website you will find links to our Privacy Policy and Terms of Use. This information is provided here so any person considering use of the Ice TimeTM service can understand the guidelines for use and our legal agreements. The same exact documents are made available to you again via links during the subscription process before you pay for the Ice TimeTM subscription. This is to ensure our subscribers are fully informed. During the on-line subscription process, you will also have access to the Terms of Service for use of STRIPE, our on-line merchant payment system. After you subscribe and you download the Ice TimeTM you will be prompted to read and understand our End User License Agreement (EULA) which is specific to the use of the software.

Thanks for licensing the worlds first lake ice hazard monitoring solution that helps you decrease risk and thrive on the ice!
Ice TimeTM aims to improve your situational awareness on the ice, and because the ice is always changing, we have developed a platform where those that travel on ice or support the sport, join together to form a community solution. To do this, we connect you to Ice TimeTM our Software as a Subscription service (SaaS), the lake ice user community, and First Responders (where applicable). Communication and sharing information are key to this approach. Your privacy and the security of your personal data is important to us. So, we want to explain how and why we gather, store, share and use your personal data.
This Privacy Policy explains what we mean in further detail below.
2. About this Policy
This Policy sets out the details relating to your personal data relationship with NextGen Environmental Research Inc. (“our”, “we” or “us”) as a user of Ice TimeTM software. The Policy applies to all Ice TimeTM services. The terms governing your use of the Ice TimeTM SaaS are defined in our Terms and Conditions of Use (the "Terms and Conditions of Use"), found also on the Ice TimeTM website.
From time to time, we may develop new or offer additional services. If the introduction of these new or additional services results in any material change to the way we collect or process your personal data we will provide you with more information or additional terms or policies. Unless stated otherwise when we introduce these new or additional services, they will be subject to this Policy.
The aim of this Policy is to:
· Ensure that you understand what personal data we collect about you, the reasons why we collect and use it, and who we share it with;
· Explain the way we use the personal data that you share with us to give you a great experience when you are using the Ice TimeTM Service; and
· Explain your rights and choices in relation to the personal data we collect and process about you and how we will protect your privacy.
We hope this policy helps you to understand our privacy commitments to you.
3. Your rights and choices
The General Data Protection Regulation or "GDPR" gives certain rights to individuals in relation to their personal data. Accordingly, we are happy to offer transparency and access controls to help users take advantage of those rights. As available and except as limited under applicable law, the rights afforded to individuals are:
· Right of access - the right to be informed of, and request access to, the personal data we process about you;
· Right to rectification - the right to request that we amend or update your personal data where it is inaccurate or incomplete;
· Right to erasure - the right to request that we delete your personal data;
· Right to restrict - the right to request that we temporarily or permanently stop processing all or some of your personal data;
· Right to object - the right, at any time, to object to us processing your personal data on grounds relating to your particular situation; the right to object to your personal data being processed for direct marketing purposes;
· Right to data portability - the right to request a copy of your personal data in electronic format and the right to transmit that personal data for use in another party's service; and
· Right not to be subject to automated decision-making - the right to not be subject to a decision based solely on automated decision making, including profiling, where the decision would have a legal effect on you or produce a similarly significant effect.
We provide the following resources so you learn more about these rights, exercise these rights with ease, and record your preferences in relation to how NextGen Environmental Research Inc. uses your personal data.
· Privacy Settings (accessed via the app) - allows you to exercise choices about the publication of certain personal data when you map icons on a map.
4. Personal data we collect
The information we collect is needed to provide a service customized to you and to support and grow this SaaS to help you thrive on the ice and improve lake ice safety. This SaaS is geographically context sensitive. When you move locations, with your GPS on your phone turned on, the information provided to you remains relevant, useful, and improves your safety. If you opt to, your location data is also made available to another trusted and registered user to improve your safety.
· Name and contact data: We collection your first and last name, email address, postal address, phone number and other similar contact information during sign up. We do not collect your password.
· Demographic data: We collect data including your age, gender, country, and preferred language during sign up.
· Geographic data: We collect geographic (i.e. latitude, longitude) and time stamp observational data based on your phone’s location and also the locations where mapping icons you placed used during software operation. You can choose not to enable the GPS data but that would limit your ability to take advantage of many novel features.
· Payment data: we collect data necessary to process your payment when subscriptions or purchases are made. This includes your payment instrument number (e.g. credit card) and the security code associated with your purchase.
· Other data: we also collected during operation of the software includes IP address, location, User Preferences, computer, browser, software information, and date and time of user activity.
5. What we use your personal data for
Ice Time is a youthful service. Little effort is placed upon deriving new information from user data. We do however want to improve the service over time and meet our regulatory and legal obligations, and so we touch on areas that may be explored as our service matures.
The information collected enables us to perform tasks that improve the service including personalization, to troubleshoot and diagnose issues with the service, develop new features and technologies, marketing, promotion, and advertising. We also need to comply with legal obligations and enforcement requests. We must also fulfill contractual obligations with third parties and to establish, exercise, or defend legal claims.
6. Sharing personal data
Ice TimeTM enables your name and location data to be shared with First Responders, upon request by another registered and trusted user of Ice TimeTM using the “My Buddy” feature. Standard emergency approaches apply (e.g., local resources and/or emergency 911).
NextGen Environmental Research Inc. does not participate in First Response operations. If we did, we would add an extra link in a chain that is supposed to be short. Instead, the needs of First Response rest solely on those you trust and those trained in search and rescue.
Ice TimeTM shares observations you make on the ice, which include a mapped feature using an icon or information communicated using text. If your Sharing settings are set to Public, the default, other users will see your anonymous mapped features. Some of the mapped feature types represent features that change constantly, like ice thickness, and so only have a short shelf-life (e.g. 7 days). Other features, like pressure ridges, are persistent for the ice period and will remain for the current ice season. The date and time of your post will be displayed with each mapped feature. If text is used your user account information (e.g. user name) will be shared to other members with the text you provide.
We do not share your location data for commercial purposes.
7. Third Party access
Others working for NextGen Environmental Research Inc: We use certain trusted third parties (e.g. providers of customer support and IT services) to help us provide, improve, protect, and promote our services. These third-party services will access your information only to perform tasks on our behalf in compliance with this Privacy Policy. We will remain responsible for the handling of your information as per our instructions.
8. Data retention and deletion
We keep your personal data only so long as necessary to provide you with the Ice TimeTM Service and for legitimate and essential business purposes, such as maintaining the performance of the Ice TimeTM Service, making data-driven business decisions about new features and offerings, complying with our legal obligations, and resolving disputes. We keep some of your personal data for as long as you are a user of the Ice TimeTM Service. For example, we keep your map icon data, text communications, and account information.
If you request, we will delete or anonymize your personal data so that it no longer identifies you, unless we are legally allowed or required to maintain certain personal data, including situations such as the following:
· If there is an unresolved issue relating to your account, such as an outstanding credit on your account or an unresolved claim or dispute we will retain the necessary personal data until the issue is resolved;
· Where we need to retain the personal data for our legal, tax, audit, and accounting obligations, we will retain the necessary personal data for the period required by applicable law; and/or,
· Where necessary for our legitimate business interests such as fraud prevention or to maintain the security of our users.
Account cancellation or deactivation: Should you choose to cancel or deactivate your account please contact support@icetime.app for assistance. Cancellation or deactivation does not ensure complete or comprehensive removal of information you provided on the service during your time as a registered user.
Compliance: We reserve the right to remove an account where a user does not comply with our Terms and Conditions and/or the End User License Agreement, or in any other case, solely at our discretion.
9. Links
We may display advertisements from third parties and other content that links to third-party websites. We cannot control or be held responsible for third parties' privacy practices and content. If you click on a third-party advertisement or link, please understand that you are leaving the Ice TimeTM Service and any personal data you provide will not be covered by this Policy. Please read their privacy policies to find out how they collect and process your personal data.
10. Keeping your personal data safe
We are committed to protecting our users' personal data. We implement appropriate technical and organizational measures to help protect the security of your personal data; however, please note that no system is ever completely secure. We have implemented various policies including encryption, access, and retention policies to guard against unauthorized access and unnecessary retention of personal data in our systems.
Your password protects your user account, so we encourage you to use a strong password that is unique to your Ice TimeTM account, never share your password with anyone, limit access to your computer and browser, and log out after having used the Ice TimeTM Service.
11. Communications
We contact you for purposes that include informational, billing, or marketing outreach. We will send you Service and administrative emails and messages. For example, each time a satellite image is published we provide an Ice Report to you. This text report summarizes what was evident in the recent satellite imagery. We may also contact to inform you of changes in our Services, Service offerings, and important Service-related notices, such as security or fraud notices or information on other products or services. Each of these forms of communication are a part of the Service and Ice TimeTM platform that together inform and decrease cost to our users. There is no option to opt-out.
12. Children and Minors
Our services are not designed for and not marketed to people under the age of 18 (minors). If you are a minor learn Ice TimeTM by engaging the software when you can, with a trusted adult that already is a registered user of the software. Learn how to use contemporary technology to improve your situational awareness while you are together. We await your direct participation in the Ice TimeTM community once you are legally considered an adult and have developed hands-on experience with lake ice dynamics in the areas where you live and travel to.
13. Changes to this policy
We try to minimize changes to this policy but update it as it is important to keep you informed. We may update this Privacy Policy from time to time by posting an updated version of it on the Ice TimeTM website. Your continued use of these services constitutes your agreement to the updated Privacy Policy on a prospective basis.
If we are involved in a reorganization, merger, acquisition or sale of our assets, your information may be transferred as a part of that deal. In such instances we will notify you (for example, to the email address associated with your account) of any such deal and outline your choices in that event.
